These Terms and Conditions (“Terms”) apply to your use of our website and to purchases made from Trapping Claws Australia (“TCA”, “we”, “us” or “our”).
By accessing our website, creating an account or purchasing a product from us, you agree to these Terms.
Please read them carefully before using our website or placing an order.
1. About These Terms
These Terms apply to:
- use of the TCA website;
- purchases made through our online store;
- communications and interactions with TCA;
- promotions, discounts and competitions where applicable; and
- products and services supplied by TCA.
Nothing in these Terms is intended to exclude, restrict or modify any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law or any other applicable law.

You may use our website for lawful personal and commercial purchasing purposes.
You must not:
- use the website for unlawful or fraudulent purposes;
- attempt to gain unauthorised access to the website or related systems;
- interfere with the operation, security or performance of the website;

- scrape, reproduce or commercially exploit website content without permission;

- use the website in a manner that infringes the rights of TCA or any third party.
We may restrict or terminate access to the website where we reasonably believe these Terms have been breached.
3. Product Information
We aim to ensure product descriptions, photographs, specifications, pricing and availability information are accurate.
However:
- colours may appear differently depending on your device or screen;
- handmade or manufactured products may have minor variations;
- product designs, components and specifications may be improved or updated from time to time; and
- measurements may be approximate unless otherwise stated.
These variations do not affect your rights under the Australian Consumer Law where a product does not comply with applicable consumer guarantees.
4. Outdoor and Product Use
TCA products are designed for outdoor, recreational and related uses.
You are responsible for using products:
- safely;
- for their intended purpose;
- in accordance with any instructions supplied;
- within your experience and ability;
- in suitable environmental and weather conditions; and
- in accordance with applicable laws and regulations.
Outdoor activities can involve inherent risks including changing weather, water conditions, wildlife, terrain, tides, currents and other hazards.
You should exercise appropriate judgement and take reasonable safety precautions when using TCA products.
5. Fishing, Crabbing, Trapping and Local Regulations
Fishing, crabbing, trapping and related regulations vary between Australian states, territories and locations and may change over time.
You are responsible for checking the current regulations that apply to:
- your location;
- the species being targeted;
- equipment type;
- equipment dimensions;
- identification requirements;
- permitted fishing or trapping areas;
- seasonal closures;
- possession limits; and
- any other applicable requirement.
Where TCA provides information about fishing, trapping or equipment regulations, this information is provided as a general guide only unless expressly stated otherwise.
Customers should verify current requirements with the relevant state or territory fisheries authority before use.
TCA is not responsible for fines, penalties or losses arising from a customer's failure to comply with applicable fishing, trapping or other laws where the product itself was supplied as represented.
6. Orders
When you place an order, you are offering to purchase the selected products subject to these Terms.
An automated order confirmation does not necessarily mean that we have accepted the order.
We reserve the right to refuse or cancel an order where reasonably necessary, including where:
- a product is unavailable;
- there has been an obvious pricing or listing error;
- payment has not been authorised;
- we reasonably suspect fraud;
- incorrect shipping information has been provided; or
- fulfilling the order would breach applicable law.
If we cancel an order after payment has been received, we will refund the amount paid for the cancelled portion of the order.
7. Pricing
Unless otherwise stated, prices displayed on the Australian TCA website are in Australian dollars (AUD) and include GST where applicable.
Shipping charges, if applicable, will generally be shown separately during checkout.
We may change prices at any time.
A price change will not affect an order that has already been accepted by us unless there has been an obvious error that we are legally entitled to correct.
8. Payment
Payment must be made using one of the payment methods offered at checkout.
Depending on the options available, these may include:
- credit or debit card;
- Shopify-supported payment services;
- PayPal;
- digital wallet services; or
- other approved payment methods.
Payments may be processed by third-party payment providers.
TCA does not generally receive or store your complete credit card information.
Your payment may also be subject to the terms and privacy policies of the relevant payment provider.
9. Product Availability
All products are subject to availability.
Stock quantities displayed on our website may occasionally be inaccurate due to simultaneous orders, inventory adjustments or technical issues.
If an item becomes unavailable after you order it, we may:
- contact you with an estimated availability date;
- offer an alternative product where appropriate; or
- cancel and refund the unavailable item.
10. Pre-Orders and Backorders
Products identified as a pre-order or backorder may not be immediately available for dispatch.
Any expected dispatch or availability date is an estimate unless expressly guaranteed.
Manufacturing, freight, customs, supplier or other delays can sometimes affect estimated dates.
If a substantial delay occurs, we may contact you with updated information and any options available to you.
Nothing in this section limits any rights you may have under the Australian Consumer Law.
11. Shipping and Delivery
We will endeavour to dispatch orders within any timeframe stated on our website.
Delivery estimates are estimates only unless we expressly agree to a guaranteed delivery timeframe.
Delivery times can be affected by circumstances outside our control, including:
- postal or courier delays;
- weather;
- natural disasters;
- peak shopping periods;
- regional or remote delivery conditions;
- transport disruption; and
- incorrect delivery information.
You are responsible for providing a complete and accurate delivery address.
If an order is returned to us because an incorrect or incomplete address was supplied, additional delivery charges may apply before the order is resent.
This does not affect your statutory rights where TCA is responsible for the delivery issue.
12. Authority to Leave
Where you select or authorise an Authority to Leave delivery option, you authorise the carrier to leave the parcel at the nominated location without obtaining a signature.
You should select a delivery location that is reasonably secure and protected from weather where possible.
Any allocation of responsibility for an Authority to Leave delivery is subject to your rights under applicable consumer law.
13. Risk and Ownership
Ownership of products passes to you once full payment has been received.
Risk will pass in accordance with applicable law and the circumstances of delivery.
Nothing in this section limits rights or remedies available under the Australian Consumer Law in relation to goods that are lost, damaged or not supplied as agreed.
14. Returns, Refunds and Consumer Guarantees
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
Depending on the circumstances, you may be entitled to a:
- repair;
- replacement;
- refund; or
- compensation for reasonably foreseeable loss or damage.
A customer's Australian Consumer Law rights apply independently of any additional warranty or voluntary return policy offered by TCA.
Where a product has a major problem, the Australian Consumer Law may allow you to choose between a refund or replacement.
Where a problem is minor, TCA may generally choose to repair the product within a reasonable time where repair is appropriate.
Please refer to our separate Returns and Refunds Policy for information about contacting us and arranging a return.
Nothing in our Returns and Refunds Policy or these Terms excludes any rights you have under applicable law.
15. Change-of-Mind Returns
TCA is not legally required to provide a refund simply because a customer changes their mind.
However, we may choose to offer change-of-mind returns under our Returns and Refunds Policy.
Any voluntary change-of-mind policy operates in addition to, and does not replace, your rights under the Australian Consumer Law.
16. Incorrect, Damaged or Faulty Products
If you believe you have received:
- an incorrect product;
- a damaged product;
- a defective product; or
- a product that does not match its description,
please contact us as soon as reasonably practicable.
We may request reasonable information such as:
- your order number;
- photographs;
- video;
- a description of the issue; or
- return of the product where reasonably necessary to assess the problem.
We will handle the issue in accordance with applicable Australian consumer law.
17. Product Modification and Misuse
Products should not be modified in a way that compromises their intended operation, structural integrity or safety.
Subject to applicable law, TCA may not be responsible for damage caused by:
- unreasonable misuse;
- deliberate damage;
- neglect;
- improper storage;
- unauthorised modification;
- failure to follow supplied instructions; or
- normal wear and tear.
This section does not exclude responsibility for defects or failures for which TCA is legally responsible.
18. Discounts and Promotional Codes
From time to time we may offer discount codes, promotional pricing or special offers.
Unless otherwise stated:
- promotions cannot be combined;
- discount codes have no cash value;
- discount codes may have expiry dates;
- certain products may be excluded;
- minimum purchase requirements may apply; and
- promotions may be subject to stock availability.
We may cancel or refuse a promotion where there has been fraud, misuse or an obvious technical or pricing error.

19. Gift Cards
If TCA offers gift cards, additional gift card conditions may apply.
Gift cards will be provided and administered in accordance with applicable Australian consumer law, including any statutory minimum expiry requirements.
Gift cards are generally not redeemable for cash except where required by law.
20. Competitions and Giveaways
Competitions, giveaways and promotional campaigns may be subject to separate terms and eligibility requirements.
Where separate competition terms are provided, those terms will apply in addition to these Terms.
21. Intellectual Property
Unless otherwise indicated, all intellectual property associated with TCA and our website is owned by or licensed to TCA.
This includes:
- trademarks;
- logos;
- business names;
- product names;
- product designs;
- photographs;
- videos;
- artwork;
- graphics;
- written content;
- website design;
- product descriptions; and
- other original material.
You may view and use website content for your own personal, non-commercial purposes.
You must not reproduce, distribute, modify, manufacture from, publish or commercially exploit our intellectual property without our written permission.
Nothing in these Terms transfers ownership of TCA intellectual property to you.
22. User Content, Reviews and Social Media
If you submit a review, photograph, comment or other content directly to TCA for publication, you confirm that:
- you have the right to provide the content;
- the content does not infringe another person's rights;
- the content is not unlawful, defamatory or misleading; and
- any statements presented as your experience are genuine.
Where you give TCA permission to use your content, you grant us permission to reproduce and display that content for the purposes agreed with you, including on our website, social media or marketing materials.
We will not intentionally represent your content as endorsing something materially different from what you submitted or agreed to.

These services are operated independently of TCA.

26. Limitation of Liability
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.
To the maximum extent permitted by law, TCA is not liable for loss or damage arising solely from:
- improper or unintended use of a product;
- failure to follow instructions;
- unlawful use of a product;
- unauthorised product modification;
- hazards inherent in outdoor activities; or
- circumstances outside TCA's reasonable control,
except to the extent that the loss or damage was caused or contributed to by TCA or where liability cannot lawfully be excluded.
27. Indemnity
To the extent permitted by law, you agree to indemnify TCA against reasonable losses, liabilities or costs resulting directly from your unlawful use of our website, infringement of another person's rights or material breach of these Terms.
This clause does not require you to indemnify TCA for loss caused by TCA's own negligence, breach of contract, unlawful conduct or other responsibility that cannot lawfully be transferred to you.

Your personal information is handled in accordance with our Privacy Policy.
Our Privacy Policy explains how we collect, use, disclose and protect personal information.
By using our website, you acknowledge that you have had the opportunity to review our Privacy Policy.
29. Changes to These Terms

The current version will be published on our website with its most recent update date.

You and TCA submit to the jurisdiction of the courts and tribunals having jurisdiction in New South Wales, subject to any rights you may have to commence proceedings in another jurisdiction under applicable consumer legislation.
